Pharmacy 777 Community Spirit Program

Terms and Conditions

Issuer

1. Memberships to the Pharmacy 777 Community Spirit Program (Community Spirit Program) are issued by 777 Franchising Pty Ltd ABN 54 162 625 765 (Issuer).

Eligibility

2. Individuals who attend a Pharmacy 777 pharmacy and are aged 16 years or over and have a current Australian residential address (Eligible Applicants) are eligible to join the Community Spirit Program.

Application

3. Eligible Applicants may apply to become a member of the Community Spirit Program (Community Spirit Member) by filling out a form or providing details at a Pharmacy 777 pharmacy.
4. To become a Community Spirit Member, Eligible Applicants must provide personal details (such as name, address, email address and phone number) to the Issuer.
5. Community Spirit Members are responsible for informing the Issuer if their personal details change.
6. The Issuer may refuse an application to become a Community Spirit Member for any reason.

Card

7. Successful applicants will be issued a Community Spirit Program card (Community Spirit Card).
8. A Community Spirit Card is not transferable and is for the personal use of the Community Spirit Member the Community Spirit Card is supplied to only.
9. Community Spirit Members are responsible for informing the Issuer if their Community Spirit Card is lost or stolen.
10. If a Community Spirit Member wishes to cancel their Community Spirit Card, that Community Spirit Member may contact the Issuer by email at info@pharmacy777.com.au or telephone on 08 9316 7811, and the Issuer will endeavour to cancel the Community Spirit Card as soon as practicable.
11. A Community Spirit Card is not a credit or charge card, is not transferable and remains the property of the Issuer.
12. The Issuer may at any time and in its absolute discretion cancel or suspend a Community Spirit Member’s Community Spirit Card or modify and withdraw a Community Spirit Member’s Community Spirit Program membership.

Personal Information

13. By becoming a Community Spirit Member you consent to your personal information being collected, used and disclosed in accordance with the Pharmacy 777 Privacy Policy, a copy of which is available at https://www.pharmacy777.com.au/privacy-policy.

Terms and Conditions

14. Acceptance of a Community Spirit Card and/or taking steps to use a Community Spirit Card constitutes as an agreement to be bound by these Terms & Conditions, as amended from time to time by the Issuer at the Issuer’s sole and absolute discretion.
15. The Issuer may terminate the Community Spirit Program at any time, and in such circumstances the Issuer will notify Community Spirit Members via the contact details provided when applying for a Community Spirit Card or as updated by Community Spirit Members.

Points

16. Community Spirit Members are eligible to accrue points on in-pharmacy purchases made at Pharmacy 777 pharmacies at a rate of 5% of a total transaction value minus exclusions (including GST) (Community Spirit Points).
17. Community Spirit Point accrual does not apply to restricted pharmaceuticals, already discounted items, health services and specified related products and any other item identified as excluded by the Community Spirit Member’s Pharmacy 777 pharmacist or pharmacy from time to time.
18. Community Spirit Points are accrued as long as the Community Spirit Member’s Community Spirit Card remains active and on a per-pharmacy basis only.
19. For every whole $1 (there is no rounding) which constitutes 5% of a Community Spirit Member’s transaction minus exclusions (including GST), 1 Community Spirit Point will be earned at that particular Pharmacy 777 pharmacy.
20. Points may be removed from a Member’s Community Spirit Card for transactions with returned or refunded products.
21. Community Spirit Points are not valid with and cannot be used in conjunction with any other offer/reward.
22. Community Spirit Points are non-negotiable, non-transferable, have no cash value and are not redeemable for cash.
23. Community Spirit Members may check their Community Spirit Points balance at any time by contacting the Issuer via email at info@pharmacy777.com.au or telephone on 08 9316 7811.
24. The Issuer may also, at the Issuer’s sole and absolute discretion, periodically send Community Spirit Members a Community Spirit Points summary using each Community Spirit Member’s personal details as provided to the Issuer by each Community Spirit Member.
25. Pharmacy 777 pharmacies may make a Community Spirit Member’s Community Spirit Points balance available in other ways.

Donation

26. For every Community Spirit Point earned by a Community Spirit Member, the relevant Pharmacy 777 pharmacy will donate $1.00 in Australian dollars to an approved cause or charity of the Issuer’s choice and at such times as determined by the Issuer.
27. The balance of a Community Spirit Member’s Community Spirit Points will reduce when the Community Spirit Member’s Community Spirit Points are donated to an approved cause or charity.
28. When a Pharmacy 777 pharmacy redeems a Community Spirit Member’s Community Spirit Points and makes a donation to a cause or charity, that Community Spirit Member will not be entitled to a tax invoice, tax receipt or tax deduction for the donation.
29. Community Spirit Members should make their own enquiries with their tax adviser to understand if any tax deductions arise in those circumstances.

Offers

30. From time to time, the Issuer will notify members by email or post of exclusive offers on products, services, monthly specials, events and early bird access to health services offered at Pharmacy 777 pharmacies.
31. Exclusive offers and events may be subject to conditions such as expiry dates, availability or other exclusions at the sole and absolute discretion of the Issuer.

Variation

32. The Issuer may make changes to these Terms & Conditions at any time without prior notice at its absolute and sole discretion.
33. A Community Spirit Member’s continued use of a Community Spirit Card after any such amendment to these Terms & Conditions will be taken as the Community Spirit Member’s acceptance of the terms of the amended Terms & Conditions. Community Spirit Members are solely responsible for checking periodically for any such amendments to these Terms & Conditions.
34. If a Community Spirit Member does not agree with the amended Terms & Conditions, that Community Spirit Member must take steps to cancel their Community Spirit Card and immediately stop participating in the Community Spirit Program.

No Representations

35. Pharmacy 777 pharmacies are not permitted or authorised to make any representation, warranty or statement on behalf of the Issuer in relation to the Community Spirit Program.
36. To the fullest extent permitted by law, the Issuer makes no representations or warranties about the accuracy, completeness, security or timeliness of the content, information or services provided by its communications for the Community Spirit Program and disclaims all warranties, either express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties' rights, and fitness for a particular purpose. 

Release

37. Community Spirit Members release the Issuer from all liability for any representations, warranties or statements.
38. The Issuer and Pharmacy 777 pharmacies will not be liable for the termination of the Community Spirit Program or any loss suffered by Community Spirit Members as a result of any termination.
39. Pharmacy 777 pharmacies and the Issuer will not be liable for any loss or damage that may arise by reason of any cancelation, suspension, modification and/or withdrawal, or if a Pharmacy 777 pharmacy ceases to be a participant in the Community Spirit Program.
40. Each Community Spirit Member agrees that the Issuer will not be liable for any special, indirect, incidental or consequential losses or damages or loss of profits suffered or incurred by a Community Spirit Member in relation to the Community Spirit Program.

Indemnity

41. To the fullest extent permitted by law, each Community Spirit Member indemnifies the Issuer and its directors, officers, employees, consultants, agents, and affiliates for and against any Community Spirit Member or third party claims, liability, damages, loss or costs arising from or in connection with the use of the Community Spirit Program or a breach of these Terms & Conditions by that Community Spirit Member.
